Privacy Policy for Public WiFi Usage and Personal Internet Connections

PocketiNet Communications, Inc. is committed to safeguarding privacy and personal information collected by us in connection with providing internet or WiFi to our customers. We do not and have never sold personal customer information to any outside sources for any purpose.

 

Information Collection and Use

PocketiNet collects two types of customer information in association with the Internet or WiFi Service: 1) personal information provided in order to access the Internet/WiFi Service; and, 2) general information that describes your use of the Internet/WiFi Service (such as IP address, location of use, session length, device type, web sites visited). We do not knowingly collect any personally identifiable information from anyone under the age of 18 through the WiFi Service.

 

In the process of accessing the WiFi Service, PocketiNet may collect voluntarily supplied personal information (such as: name, address, credit card number and email address) in order to grant access to free or paid WiFi Services. This information will be retained by our system in order to process the transaction. Such information may also be used to improve your customer experience (e.g., simplify the logon process) or inform you of products and services available in your area.

 

Anonymous or aggregated information (such as user zipcodes) and service usage information may be used to improve service offerings or for PocketiNet’s marketing purposes.

 

Legal Requirements

 

PocketiNet may disclose personal information if required to do so by law or legal process, or as required by a law enforcement authority, when it is necessary to protect the rights or property of PocketiNet, or when disclosure is otherwise necessary or advisable. By using the Internet/WiFi Service, you expressly consent to the transfer of your communications, including any personal information associated with the use of the WiFi Service on your device, to PocketiNet in order to receive the Internet/WiFi Service and in order to comply with legal requirements.

 

Information Security

All information collected in association with your use of the Internet/WiFi Service is protected by physical, electronic and procedural security safeguards. Although PocketiNet takes these reasonable steps to safeguard and prevent unauthorized access to personal and private

 

information, we assume no responsibility for the acts of anyone who gains unauthorized access to this data. PocketiNet makes no warranty, express or implied, that we will prevent unauthorized access to your personal or private information.

Terms & Conditions:  By signing the PocketiNet Communications Inc. customer agreement (“Agreement”), incorporating these Terms & Conditions by reference, you are agreeing with the terms and conditions set forth herein, and you are certifying that you are 18 years of age or older and have signature authority to make this Agreement.  PocketiNet may change these Terms and Conditions at any time in its sole discretion.  Any such change is effective immediately upon it being posted on the PocketiNet website (www.pocketinet.com) or delivery of any other notice to you.  Continued use of the Services after such change becomes effective constitutes your agreement and acceptance of the change.

 

 

Limitation of Warranties and Liability; Disclaimer of Warranties: 

YOU EXPRESSLY AGREE THAT USE OF THE SERVICES IS AT YOUR SOLE RISK.  NEITHER POCKETINET NOR ANY OF ITS UNDERLYING LICENSORS, EMPLOYEES, SUPPLIERS OR AGENTS MAKE ANY WARRANTY AS TO THE RESULTS TO BE OBTAINED FROM USE OF THE SERVICES.  THE ENTIRE RISK OF THE QUALITY OF THE SERVICES IS BORNE BY YOU.  SHOULD THE SERVICES PROVE DEFECTIVE IN ANY RESPECT, YOU AND NOT POCKETINET NOR ITS SUPPLIERS OR AGENTS ASSUME THE ENTIRE COST OF ANY SERVICE AND REPAIR.  THE SERVICES ARE PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE OR WARRANTIES THAT THE SERVICES ARE MERCHANTABLE OR FIT FOR A PARTICULAR PURPOSE OR NON-INFRINGING, WARRANTIES THAT THE SERVICES ARE FREE OF DEFECTS, OR OTHERWISE, OTHER THAN THOSE WARRANTIES (IF ANY) WHICH ARE IMPLIED BY AND INCAPABLE OF EXCLUSION, RESTRICTION, OR MODIFICATION UNDER THE LAWS APPLICABLE TO THIS AGREEMENT, ALL SUCH WARRANTIES BEING EXPRESSLY DISCLAIMED.  TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEITHER POCKETINET OR ANY OF ITS UNDERLYING LICENSORS, EMPLOYEES, SUPPLIERS OR AGENTS SHALL HAVE ANY LIABILITY FOR DIRECT, INCIDENTAL, OR INDIRECT DAMAGES ARISING FROM THE USE OF THE SERVICES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND REGARDLESS OF THE LEGAL OR EQUITABLE THEORY (CONTRACT, TORT, OR OTHERWISE) UPON WHICH THE CLAIM IS BASED.

 

Payment of Fees and Penalties:

Monthly service payments shall be billed on the first day of service and monthly thereafter by the 10th of the month, one month in advance. Payment shall be due to PocketiNet Communications, Inc. within fifteen (15) days from the date of the invoice. A thirty-dollar ($30.00) late fee shall be assessed on accounts not paid within fifteen (15) days of invoice. Accounts remaining unpaid for thirty (30) or more days shall be deemed delinquent and shall accrue interest at 1.5% per month on all outstanding principal amounts until paid. Delinquent accounts shall be placed on "accounting hold" and services shall be suspended until the account is paid in full. For any Customer account that has been placed on suspended service there shall be due a One Hundred and Fifty Dollar ($150.00) reconnection charge to reactivate Customer's services. PocketiNet may assess an additional $25 fee for any check returned for nonpayment.  You agree to pay all applicable taxes, whether imposed on PocketiNet or directly on you, which will be applied and included in bills issued to you.  You authorize PocketiNet to charge any amounts payable by you in connection with Services automatically to the credit card you provided in the subscription process or credit card you provide thereafter.  If you choose to bill the Services to your credit card, your right to receive the Services is subject to any limits established by your credit card issuer.  

 

PocketiNet Internet Broadband Disclosures

PocketiNet provides this Internet Broadband Disclosure in order to address our customer’s questions regarding our internet service delivery policies, agreements, and other information about our broadband Internet access services.  Additionally, the Federal Communications Commission ("FCC") requires that PocketiNet and other providers of broadband Internet access services disclose certain information regarding those Internet services. The information required for disclosure under the FCC's rules is found below and in the various policies and documents listed and linked on this page. To assist you in finding the information you're looking for, we highlight below information that the FCC specifically calls for in the 2018 Restoring Internet Freedom Order.

Network Practices

PocketiNet does not discriminate against lawful Internet content, applications, services, or non-harmful devices. The sections below provide an overview of PocketiNet's network practices with respect to its broadband Internet access services.

 

Blocking

PocketiNet does not block or otherwise prevent end user access to lawful content, applications, services, or non-harmful devices. PocketiNet does engage in reasonable network management practices described below.

 

Throttling

PocketiNet does not degrade or impair access to lawful Internet traffic on the basis of content, application, service, user, or use of a non-harmful device. PocketiNet does engage in reasonable network management practices described below.

 

Affiliated Prioritization

PocketiNet does not directly or indirectly favor some traffic over other traffic, including through use of techniques such as traffic shaping, prioritization, or resource reservation, to benefit an affiliate.

 

Paid Prioritization

PocketiNet does not directly or indirectly favor some traffic over other traffic, including through use of techniques such as traffic shaping, prioritization, or resource reservation, in exchange for consideration, monetary or otherwise.  Our services are designed and managed with the intent to deliver to all customers their contracted level of performance.

Network Management

PocketiNet manages its network with one goal: to deliver the best possible broadband Internet access service to all of its customers. To further this effort, PocketiNet uses reasonable network management practices that are consistent with industry standards. PocketiNet uses various tools and techniques to manage its network, deliver its service, and ensure compliance with the Acceptable Use Policy and the Customer Agreement. These tools and techniques are dynamic and can and do change frequently. Network management activities may include identifying spam and preventing its delivery to customer email accounts, and detecting malicious Internet traffic and preventing the distribution of, or inadvertent access to, malware, phishing, viruses, or other harmful code or content.

 

As the Internet and its related technologies continue to evolve, PocketiNet’s network management tools will also keep pace so we can deliver an excellent, reliable, and safe experience to all of our customers. We will provide updates here as well as in other locations if we make significant changes to our network management techniques.

 

PocketiNet currently does not maintain a separate system to assist with managing times of congestion. As our network technologies and usage of the network continue to evolve, we reserve the right to implement a new congestion management system if necessary in the performance of reasonable network management and in order to maintain a good broadband Internet access service experience for our customers, and will provide updates here as well as in other locations if a new system is implemented.

 

Application-Specific Behavior

PocketiNet provides its broadband Internet access service customers with full access to all the lawful content, services, and applications that the Internet has to offer. PocketiNet does not block or rate-control specific protocols or protocol ports (except to prevent spam, malicious attacks, and identity theft), does not modify protocol fields in ways not prescribed by protocol standards, and does not otherwise inhibit or favor certain applications or classes of applications.

 

Device Attachment Rules

PocketiNet recommends our PocketiFi Managed WiFi and Router Service for the best possible Internet experience.  However, other commercial ethernet routers may also be used to access our broadband Internet service with varying degrees of performance based on the device’s capabilities. In order for a router to be used on the network, we recommend that it possess the relevant UL and FCC certifications.

 

Security

PocketiNet employs a number of practices to help prevent unwanted communications, such as spam, and protect the security of PocketiNet's customers and network. We limit the number of login, SMTP, DNS, and DHCP transactions per second (at levels far above “normal” rates) that customers can send to our servers in order to protect them from Denial of Service (DoS) attacks. (We do not disclose exact rate limits in order to maintain the effectiveness of these measures.) In order to further protect our customers, PocketiNet blocks a limited number of ports that are commonly used to send spam, launch malicious attacks, or steal a customer’s information. Performance Characteristics Service Description

PocketiNet provides a detailed summary of its Internet service performance containing information about speed and latency, as well as other related topics. We are continually upgrading our network to deliver state-of-the-art broadband services at the highest possible speeds available within our service area. Our team engineers and supports the network with the goal to consistently deliver service at the contracted speed for the particular service tier. PocketiNet also provides a speed test page, so you can test your connection for yourself.

 

Other Services on Our Network

PocketiNet currently provides certain Metro-Ethernet enterprise business services (using IP-based technologies) to its customers over the same physical network used to deliver PocketiNet broadband Internet access service to residential and small and medium business customers. Our Metro-Ethernet enterprise business services are not provided over the Internet but are provisioned with separate service capacity and delivered over separate service flows using Ethernet Layer 2 switching technologies. These services are designed to protect the integrity and reliability of the PocketiNet Internet service, which is delivered on a best-efforts basis.
